Michael G. Oleinik

Mike is a registered patent attorney at Quinn IP Law who focuses on the preparation and prosecution of domestic, international, and foreign patent applications, portfolio counseling and management, product clearance and freedom to operate opinions. Mike’s experience extends to drafting legal opinions, IP due diligence, and corporate IP & asset transfers. Mike served as lead counsel against Samsung in an interference proceeding, now coined a derivation proceeding before the United States Patent and Trademark Office (USPTO) as well as multiple patent reexaminations.

Throughout his career, Mike has been involved in litigating high stakes patent, trademark, copyright, and trade secret cases. This includes acting as lead counsel in numerous cases. He oversaw communications with the client, managed day-to-day operations, took and defended a total exceeding 200 fact and expert depositions, drafting claim construction and summary judgment briefs, and arguing the ensuing motions in court. Mike has worked hand-in-hand in federal court with clients like LG, Toyota, Kingston Technologies, Ademco, Actel, Roland DG, nCUBE, and Mentor Graphics, among others, to successfully enforce or defend their respective patent portfolios and related claims, achieve complete capitulation from the adversary or a favorable settlement, and where necessary taking the case through trial.

Mike graduated with honors with a B.S. from the University of Florida in electrical engineering. He worked at Western Digital, where he performed integrated circuit design. Mike also worked at Cincinnati Milacron Electronic Systems Division.

After graduating fourth out of 217 students from Pepperdine University School of Law, Mike took the bar exam in California and New York, where he is currently licensed to practice. He has accumulated over two decades of experience in different facets of intellectual property law.  Examples include patent prosecution, extensive patent litigation, evaluating cease and desist letters; prelitigation counseling regarding prospective litigation strategy, evaluating settlement negotiations, and patent licensing. His experience includes negotiating and, where it was appropriate, drafting numerous IP license agreements including on behalf of HP, LSI Logic, Motorola, Qualcomm, LG, Kia, Divergent3d, nVidia, and Nissan, to name a few. Mike also has experience in writing various commercial agreements, NDA agreements, and employment agreements.

Prior to joining Quinn IP Law, Mike served at various firms where he gained invaluable experience. Mike was a former partner at McDermott, Will & Emery; a partner at Lee, Hong, Degerman, Kang & Waimey, and an associate at Latham & Watkins. Most recently, Mike worked as senior counsel at Arent, Fox Schiff.
